- A streetwear brand that has been consistently denied a federal trademark for being too “scandalous” will be having its case heard by the Supreme Court in spring. The Justices will decide how much “scandalous” speech is protected by the First Amendment (hopefully clearer than Justice Potter Stewart’s infamous concurrence in Jacobellis v. Ohio in which the Court found that the Constitution protects obscenity except hard core pornography: "I shall not today attempt further to define the kinds of material I understand to be embraced within that shorthand description; and perhaps I could never succeed in intelligibly doing so. But I know it when I see it and the motion picture involved in this case is not that.")
